Warrant issued for arrest of NAM1 fake – Lawyer Maurice Ampaw claims

Lawyer Maurice Ampaw, who forms part of a tall list of customers who have their monies locked up at Menzgold, has described as fake the arrest warrant issued by a circuit court for the arrest of CEO of the embattled gold dealership firm, Nana Appiah Mensah, affectionately called “NAM 1”.

He is not the first to say this as earlier on Asempa FM’s political talk show Ekosii Sen, the General Secretary of the National Democratic Congress (NDC) Johnson Asiedu Nketia reacted in a similar manner.

Speaking on Asempa FM’s budding weekend entertainment show dubbed “Zoblazo” with host Prince Tsegah, Lawyer Maurice Ampaw noted that some invalidities in the warrant that had tendencies to render it “bogus and incompetent”.

An Accra Circuit Court on Wednesday issued a warrant for the arrest of the embattled Menzgold founder, NAM1 and two others, Rose Tetteh believed to be his wife and his sister Benedicta Mensah for defrauding customers by “false pretence.”

The issuance of the warrant comes on the back of a demonstration in the Ashanti Regional capital, Kumasi, by some angry Menzgold customers who burnt vehicle tyres and blocked a major road in demand of their funds.

But Lawyer Maurice Ampaw throwing more light on some technicalities said the following:

The warrant was done in a haste. The Supreme Court is on vacation hence no judge has resumed work. We can’t use the president against NAM1 but rather they had to use the state to declare NAM1 wanted. The president cannot be a party to a criminal suit. It amounts to abuse.

“This is an old type of warrant. The registrar of the circuit court must be asked if he is part of the conspiracy. Under which influence do you sign such a document knowing its coming from a Supreme Court [on vacation]. How can the also president be in this matter?” He queried.

Ask the way forward, Lawyer advised the Menzgold customers not to jubilate because “there is nothing good that will come out of NAM1’s arrest.”

According to Lawyer Maurice, the “arrest will lead to bail and after it’s all about adjournment” so he has advised the customers to rather “push government to sit down and reason together with NAM1 to look into his business so we know how to go forward.”

He queried, “how many people can survive 5 years if Menzgold is in court?”
