The party has subsequently appointed Lawyer Gary Nimako as the Director of the Directorate.

According to a press release issued by the party, the decision was taken on Wednesday.

“The decision was taken by the National Executive Committee (NEC) of the Party, at its meeting on Wednesday, October 5, 2022, pursuant to Article 10 (7)(3) of the NPP Constitution.”

The Directorate shall, among other things, be responsible for advising the General Secretary of the party in the performance of his functions on legal matters affecting the Party, including Members of the Party and ancillary matters of legal nature in the day-to-day administration of the party.

The Legal Directorate is also tasked with the responsibility of coordinating the Party’s legal cases and resolving internal legal issues as and when they arise, while providing education on the internal Disciplinary and Grievance Procedures enshrined in the NPP Constitution.

The Legal Affairs Director is expected to work in close collaboration and coordination with the Constitutional and Legal Committee of the Party established under Article 10(3)(6) of the Constitution as a Standing Committee of the Party’s National Council.

Mr. Gary Nimako is a long-standing Member of the NPP’s legal team and has been instrumental in the operations of the party.

Mr. Nimako has also served as a member of the Constitutional and Legal Committee of the party’s National Council.

This comes on the back of a petition some 13 Buem constituents filed at the Hohoe High Court over the validity of the parliamentary results in that constituency.

The persons in the Oti Region are challenging the election of the former National Organiser of the NDC, Kofi Adams as Member of Parliament (MP)-elect for the area.

The petitioners in their suit argued that they were disenfranchised given that parliamentary elections were not held in 13 electoral areas of Satrokofi, Akpafu, Lolobi and Likpe, where they were expected to cast their ballot.

The petitioners are therefore seeking an “order of perpetual injunction restraining Kofi Adams from holding himself out as Member of Parliament-elect for the constituency and or presenting himself to be sworn in as such.”

Reacting to the suit, the Director of the Legal Affairs, Abraham Amaliba, said the party has not been served with the injunction.

However, he indicated the necessary steps have been initiated to address the issue.

“We received a call that this is what has happened in Hohoe in respect of Buem and we are yet to be served but in the meantime, we are convening on Tuesday for an emergency meeting.

“We have also asked to be given copies of what the NPP filed. The meeting will then determine our next line of action,” he said in an interview on Accra-based Citi TV.

The petitioners are also seeking a cancellation of the elections held in the constituency and the conduct of a new one which will include the 13 electoral areas.

Kofi Adams was declared Member of Parliament-Elect after he polled 18,560 votes of the valid votes cast in the December 2020 election.

His close contender, Lawrence Kwame Aziale of the New Patriotic Party (NPP) polled 6,854 votes, a difference of 11,706 votes.

But the petitioners contend that, the total registered voters for the 13 Electoral Areas in SALL is 17,764.

Mr. Kwabena Agyapong has said his, over two years suspension, remains unconstitutional, praying that good sense of judgment will prevail in his case.
Kwabena Agyapong was suspended indefinitely along with the Second Vice Chairman, Sammy Crabbe, after they publicly kicked against the suspension of his close ally, the National Chairman, Mr. Paul Afoko.
Their conduct, the party’s Disciplinary Committee said, violated Article 3(d) of the party’s constitution which demands members to publicly uphold the party’s decisions.

They were accused of frustrating the efforts of the then opposition party to focus on winning the 2016 general elections after staying in opposition for eight years.
The suspension calmed troubled NPP waters, after months of internal wrangling made the party a laughing stock among its political rivals, the NDC.
But the National Council of the NPP after a meeting over his suspension has refuted claims by its suspended General Secretary that his suspension was illegal.
According to the Deputy General Secretary, Nana Obiri Boahen, the Council followed all due processes in handing out the decision and takes serious note of the comments by the estranged General Secretary.

“After the National Council met, we wish to make it clear that, Mr. Kwabena Agyapong’s suspension was legal and constitutional” he said on Accra-based Okay FM.
He noted that the matter of unconstitutional suspension, does not arise anywhere.
The NPP, he stressed, believes in Constitutionalism and Rule of Law, adding that the business of Mr. Agyapong alluding to a mandate procured at “Tamale where the Party grassroots recognized my (his) contribution to the Party” is misplaced and fallacious.

Lawyer Obiri Boahen maintained that whatever steps the party took, leading to the suspension of Mr. Kwabena Agyei Agyapong were all legally, and constitutionally proper and acceptable.
