The 30-year-old was shown a straight red card for a foul on Spurs midfielder James Maddison and would have faced a three-match suspension for serious foul play.

However, United successfully argued that the decision to send him off was wrong and Fernandes will now be available for his side’s forthcoming Premier League fixtures against Aston Villa, Brentford and West Ham.

Erik ten Hag’s side were 1-0 down when Fernandes was sent off and proceeded to lose 3-0, their third league defeat of the campaign.

The incident came in the 42nd minute at Old Trafford with Fernandes slipping and sticking out a leg to catch Maddison halfway up his shin as he went past him.

“Never a red card – that is my view,” Fernandes told BBC Match of the Day after the game. “I agree that it is a foul.

“The referee tried to tell me that as he saw it was a clear contact with the studs. No. I didn’t touch him with the studs or even the foot, it was my ankle. It is a clear foul.

“If he wants to give me a yellow because they are going to go on a counter then I agree. But more than that, no. It is not the case.”

United’s next match is against Porto in the Europa League on Thursday before they return to league action against Villa on Sunday.

George Afriyie’s appeal case against GFA dismissed by CAS https://www.adomonline.com/george-afriyies-appeal-case-against-gfa-dismissed-by-cas/ Mon, 06 May 2024 14:06:16 +0000 https://www.adomonline.com/?p=2390586 The Court of Arbitration for Sport (CAS) has rejected the appeal of George Afriyie, a Presidential aspirant for the Ghana Football Association (GFA), against his disqualification from the 2023 Elections.

This decision solidifies Kurt Okraku’s position as the GFA President for a second term, as he ran unopposed last year.

Afriyie’s disqualification came after he failed to meet the required number of GFA members supporting his candidacy.

Despite his appeal to the Elections Appeals Committee, which upheld his disqualification, Afriyie pursued legal action by filing an appeal at CAS.

However, the ruling delivered on Monday, May 6, confirms the dismissal of Afriyie’s appeal, directing him to pay legal fees amounting to 1000 Swiss Francs (15,266 Ghana Cedis).

In last year’s elections held in Tamale on October 5, incumbent GFA President Kurt Okraku retained his seat with a significant majority.

Mr Okraku secured 117 out of 120 votes, with two delegates voting against him and one abstaining.

Below is the ruling by CAS:

Vybz Kartel’s life imprisonment sentence overturned after appeal https://www.adomonline.com/vybz-kartels-life-imprisonment-sentence-overturned-after-appeal/ Fri, 15 Mar 2024 12:31:02 +0000 https://www.adomonline.com/?p=2369299 Jamaican dancehall artist, Vybz Kartel’s conviction for murder has been overturned.

The 48-year-old was given a life sentence in 2014 for the killing of Clive “Lizard” Williams on the Caribbean island.

His successful appeal, heard by the Privy Council in London, argued that a juror accused of trying to bribe others should have been thrown off his trial.

Authorities in Jamaica will decide whether the case should be retried.

The musician, real name Adidja Palmer, is one of the country’s most popular artists and has collaborated with performers such as Jay-Z and Rihanna.

His 64-day trial was one of the longest in Jamaican history, and ended with Kartel being ordered to serve a minimum of 35 years in jail.

This was later reduced to 32-and-a-half years.

The trial heard that victim Clive Williams and another man, Lamar Chow, were given two unlicensed firearms belonging to Kartel for safekeeping.

When they failed to return them at an agreed time, prosecutors said, they were summoned to Kartel’s house in August 2011.

Chow told the trial they were attacked and the last thing he saw was Clive Williams – who was never seen alive again – lying motionless on the ground.

The house burned down days later and a body was never recovered.

Kartel and his co-accused Shawn Campbell, Kahira Jones and Andre St John had maintained their innocence since the original trial.

Their appeal hearing last month before The Privy Council, which serves as the highest court of appeal in Jamaica and other Commonwealth countries, was their last chance to reverse the verdict.

Delivering the council’s ruling, a panel of justices said that a juror accused of attempting to bribe fellow jury members was not removed.
The judge let them remain on the case and have a say in the final verdicts.

Allowing this juror to stay, the council said, was “fatal to the safety of the convictions which followed” and “an infringement of the [defendants’] fundamental right to a fair hearing”.
The men had also argued that jurors were sent to reach a verdict late in the day, putting them under “undue pressure” to do so.

They had also argued that a key piece of mobile phone evidence – a text message allegedly sent from Kartel’s phone – presented in court had been obtained in breach of guidelines.

However, the panel did not rule on these matters, finding that the allegations of bribery alone were serious enough to dismiss the guilty verdicts.

Vybz Kartel is known worldwide for hits including Clarks, Ramping Shop and Summer Time, and his success led to him launching lines of shoes, alcohol and condoms.

The singer also became the first dancehall artist to star in his own reality TV show, Teacha’s Pet.

Casemiro: Manchester United decide not to appeal against red card https://www.adomonline.com/casemiro-manchester-united-decide-not-to-appeal-against-red-card/ Tue, 14 Mar 2023 14:48:12 +0000 https://www.adomonline.com/?p=2227747 Manchester United have decided not to appeal against the red card shown to Brazil midfielder Casemiro in Sunday’s 0-0 draw with Southampton.

Referee Anthony Taylor initially booked Casemiro for a tackle on Carlos Alcaraz, but then sent him off after going to the television monitor on the advice of the video assistant referee.

United believed there was little chance of the decision being overturned.

Casemiro will now serve an immediate four-match domestic suspension.

The additional game comes because it was his second dismissal of the season, following a red card against Crystal Palace in February.

He will miss the FA Cup quarter-final against Fulham and Premier League games against Newcastle United, Brentford and Everton.

“Casemiro is across European leagues, in over 500 games he had never a red card and now he has twice,” United manager Erik ten Hag said after the Southampton game.

“He plays tough but he plays fair, also in this he is playing fair. Same as against Palace, so it is very debatable.

“When you freeze it looks bad, but everyone who knows something about football, who is acting on top football, they know what is bad and what isn’t bad, what is fair.

“I tell you, Casemiro is a really fair player. Tough but fair and it shows over 500 games in big leagues, never sent off.”

Defender Raphael Varane added: “He’s a player who’s very important for us.

“He brings balance to the team and to the squad, but we have a great squad and we have to find another balance without him.

“But we have good players in every position on the pitch and we’re ready for the next games.

“I think he was very disappointed because nobody wants to get out of the pitch before the end but as I say it’s part of football.”

Akuapem Poloo files Notice of Appeal against 90-day jail term https://www.adomonline.com/akuapem-poloo-files-notice-of-appeal-against-90-day-jail-term/ Tue, 07 Dec 2021 20:28:40 +0000 https://www.adomonline.com/?p=2055283 Lawyers of actress Rosemond Alade Brown, popularly known as Akuapem Poloo, have filed a notice of appeal against the 90-day jail term handed to her.

They are requesting a reversal of the dismissal of an earlier petition seeking a non-custodial sentence for the actress by the High Court.

The notice of appeal, which was filed at the Appeal’s Court only five days after her earlier petition, was dismissed by Justice Ruby Aryeetey who ruled that the 90 days custodial sentence imposed on her by the Circuit Court was not “manifestly excessive” and “harsh”.

Her lawyers have also filed a notice for bail.

It will be recalled that earlier this year, Akuapem Poloo was arrested following an image she posted on her Instagram page the previous year. In the image, the actress, who was nude, is seen kneeling before her half-naked son.

MORE:

The actress explained that the picture is an artistic expression of her sentiments towards her son. This justification didn’t go down well with Child Rights International, a child advocacy organisation, which said the picture was an infringement on the rights of the child.

They pursued the matter in court which culminated in the 90-day custodial sentence.

But the lawyers of the actress are asking the Appeals Court to set aside the 90-day custodial sentence and replace it with either a non-custodial sentence or a fine.

Akuapem Poloo is currently serving her jail term.

The sentence was described as harsh by her lawyer, who subsequently appealed against it on the instructions of his client.

However, her lawyers failed to complete processes to secure her release on time after she was granted bail of GH¢80,000 with two sureties by the Criminal Division of the High Court.

This situation took her to prison for a few days before she was finally released.

New twist to Jomoro MP’s case https://www.adomonline.com/new-twist-to-jomoro-mps-case-2/ Thu, 01 Jul 2021 23:28:29 +0000 https://www.adomonline.com/?p=1981406 The order by a Sekondi High Court judge, Justice Dr Richmond Osei Hwere, asking the Jomoro Member of Parliament (MP), Dorcas Affo-Toffey, to produce copies of her certificate renouncing her Ivorian citizenship, has been challenged.

Lawyers for the MP have filed an appeal at the Court of Appeal in Accra arguing that the judge erred in making such orders.

The MP stands accused of perpetuating illegality by contesting the 2020 parliamentary election when she has multiple citizenships.

She has denied the allegations as made by Joshua Emuah-Kofie who petitioned the High Court over her eligibility.

The court at its hearing on June 22, 2021 based on an argument by lawyers of the petitioner to have the respondent to produce documentary evidence of her renounced citizenship to Ivory Coast, ordered that such be done within 10 days.

In a writ filed on June 29, 2021, lawyers of Mrs Affo-Toffey are appealing to the court to quash the orders by Justice Dr Richmond Osei Hwere.

Furtherance to their appeal, they indicated that the High Court judge erred in law by assuming that evidence of renounced citizenship could only be documentary.

Akuapem Poloo’s lawyers finally appeal her 90-day sentence https://www.adomonline.com/akuapem-poloos-lawyers-finally-appeal-her-90-day-sentence/ Mon, 19 Apr 2021 14:37:05 +0000 https://www.adomonline.com/?p=1949803 Lawyers for actress, Rosemond Alade Brown, popularly known as Akuapem Poloo, have filed an appeal against her 90-day jail sentence.

The Accra Circuit Court on Friday, April 16, 2021, handed Poloo a 90-day sentence for posing nude with her then seven-year-old son to mark his birthday.

However, her lawyers on Monday filed the appeal at the Accra High Court [Criminal Court 2 Division] over what they described as a harsh sentence.

The lawyers in their appeal are praying for a lesser sentence in the form of a fine and also for a stay of the sentence while the appeal case is determined.

The judge, Christiana Cann while pronouncing the judgment held that it was necessary to impose a custodial sentence on Akuapem Poloo to serve as a deterrent to those who continue to post obscene images.

She stated that the prevalence of publication of materials had the potential to corrupt public morals, affect the best interest of children, violate the right to privacy, as well as the country’s moral image needed to be curbed.

RELATED:

Meanwhile, the actress even before she could settle in a correctional facility, took to her Instagram page to acknowledged Ghanaians and her colleagues in the creative arts industry for their love and support.

She described her incarceration as a test she would have to go through, adding, however, that as the strong person that she is, she will survive the phase.

She also asked her fans and Ghanaians to remain strong, saying all she needed was their prayers.
