Supreme Court sets date to hear suit against Chief Justice removal process

The Supreme Court has scheduled April 2, 2025, to hear an injunction application filed by New Patriotic Party (NPP) Member of Parliament for Old Tafo, Vincent Assafuah.

The suit challenges the procedural legality of President John Mahama’s actions regarding the potential removal of Chief Justice Gertrude Torkonoo, following the receipt of three petitions.

In the meantime, Chief Justice Torkonoo has written to the President, with copies sent to other stakeholders, requesting copies of the three petitions seeking her removal from office.

On Tuesday, the presidency announced that President Mahama was consulting the Council of State following the three petitions submitted to his office regarding the Chief Justice’s removal.

However, Assafuah, invoking the Supreme Court’s original jurisdiction under Article 2(1)(b) of the Constitution, is seeking multiple declarations on the proper interpretation of constitutional provisions governing the removal of a Chief Justice.
