Police officers not debt collectors – Lawyer to Ghanaians

Some police officers

A legal practitioner, Jennifer Afumwaa Nyamekye, has cautioned Ghanaians to desist from using police officers to chase debtors.

She said debt collection
is not part of police officer’s duties so people must abstain from it.

The lawyer said any police officer who engages in debt collection is putting him or herself in trouble because those cases are more like civil cases, and it is not appropriate for them to dabble in those matters.

She said normally police officers who engage in such matters do that as a favour, but legally it is not right.

The legal practitioner added that police officers could come in if a debtor defrauds a creditor.

“Though police officers are not permitted to chase debtors on behalf of creditors, they can arrest the defaulters,” she added.

She emphasised that a creditor could chase a successor of a debtor for his/her money if the non-payer dies.

She urged creditors to do proper checks and sign agreements with people they give money to because claiming monies from debtors is somehow difficult.

She made these statements when speaking on Adom TV’s legal show ‘Me Wo Case Anaa’ with Afia Pokua (Vim Lady).
