High Court sets date to deliver verdict on NPP’s mandamus application

The High Court in Accra has set Wednesday, January 1, 2025, to deliver its verdict on the New Patriotic Party (NPP) mandamus application against the Electoral Commission (EC).

The decision on Tuesday, December 31, follows the Supreme Court’s order for re-hearing of the application by a new High Court judge.

The verdict on the case is therefore expected to be given by the court presided over by Justice Forson Baah Agyepong.

In court on Tuesday, the National Democratic Congress(NDC) lawyers and its parliamentary candidates in the four disputed constituencies argued that the mandamus application filed by the NPP is effectively an election petition disguised as a procedural request.

Lawyer Tameklo, contended that allegations such as intimidation and duress—cited by the EC as reasons for nullifying the election results—are substantive matters that fall under Sections 16 and 20 of PNDC Law 284 and require evidence to be resolved in court.

He asserted that, the case filed constitutes an election petition rather than a straightforward mandamus application.

However, Gary Nimako, counsel for the NPP parliamentary candidates, dismissed the NDC’s objection as misconceived.

He maintained that the NPP’s application is properly before the court and does not violate procedural rules.
