Bagbin rushed to create confusion; ruling unconstitutional – Afenyo-Markin

-

The Member of Parliament for Effutu, Alexander Afenyo-Markin, has criticized Speaker of Parliament, Alban Bagbin for approving a motion by Haruna Iddrisu that called for four MPs to vacate their seats,

According to hi, the decision by the Speaker is unconstitutional.

In an interview on Citi FM, Afenyo-Markin argued that, Speaker Bagbin lacked the legal authority to make such a ruling.

He indicated that, no law grants him the power to compel MPs to vacate their seats.

“The Speaker has no mandate to make a ruling on a statement under Order 93. According to our rules, when a statement is made, members may comment, and if Mr. Speaker wants to make consequential orders, he refers the matter to a committee. Order 93(6) is very clear on this, and we drew his attention to it. He had no authority to issue such a ruling, and it has never been part of our rules.

“If an applicant seeks a determination, it must come through a motion. So one would wonder why the Speaker chose to bypass Haruna Iddrisu’s notice of motion and make a direct ruling,” he said.

Alban Bagbin’s ruling affected Cynthia Mamle Morrison (NPP, Agona West), Kwadjo Asante (NPP, Suhum), Peter Kwakye-Ackah (NDC, Amenfi Central), and Andrew Amoako Asiamah (Fomena), who has rejoined the NPP ahead of the 2024 elections.
