Amantey argued that creating this role exceeded the authority of the Police Council and the Presidency, as neither the Constitution nor the Ghana Police Service Act provides for a Deputy Inspector General specifically dedicated to operations.

Though the Police Service Regulations mention an office for operations, they do not designate a deputy position for it.

Amantey’s judicial review application accused the President and Police Council of acting unlawfully.

In his ruling, Justice Richard Apietu explained that the High Court’s supervisory jurisdiction was not applicable here because it pertains to decisions made by lower adjudicating bodies, which the President and Police Council are not.

He further noted that their actions were administrative rather than judicial, leading to the dismissal of the application.

“If all you want is money and goodies instead of focusing on development projects, how can progress happen? They may have enough funds for meaningful investments but choose to spend only a little to win your votes,” he stated.

“Anyone who fails to see the NDC’s contributions to development in the Ashanti Region must not be paying attention. Our projects benefit everyone. If the other party offers money based on status without tangible community improvements, and you still vote for them, we might also follow that path.”

According to a member of Parliament’s Defence and Interior Committee, Peter Lanchene Toobu, the incident, in which over six million cedis were stolen, reveals a failure in the country’s security responsiveness.

“What happened in Adabraka in broad daylight is an embarrassment to our whole security architecture. It is an embarrassment and a failure for us to bring our citizens to a level where they would be security conscious,” he said in an interview on JoyNews’ AM Show on Monday, November 4.

The robbery involved four armed, masked men who fired shots to disperse the crowd before looting large bags of cash from a parked Toyota Corolla. Despite the daylight setting and public location, no immediate intervention occurred, which Mr. Toobu sees as a critical lapse in police vigilance.

He criticized both the police and the business owner, stating that better security measures could have prevented the robbery. He stressed that the event serves as a wake-up call, showing that citizens need to be more security-conscious and proactive.

Mr. Toobu also questioned the jewelry store owner’s security measures, noting that businesses handling large volumes of cash should consider police escorts. He pointed out that the Ghana Police Service could provide such services upon request, especially for high-risk businesses, adding that the responsibility for personal security begins with the business owners.

“Your personal security is your responsibility. When we are talking about security on another level, people are trained and have the expertise to grant you service. The Ghana Police are supposed to provide that service, and that opportunity for you to be served depends on how you open up,” he said.

“Armed robbers are attracted to cash and motivated by money, so when you generate money in your business, you should know that this is a magnet for robbery. If you know that, what would you do to provide security for yourself?” he asked.

Supporting this view, criminologist Dr. Jones Opoku Ware from Kwame Nkrumah University of Science and Technology advocated for increased police patrols in high-risk commercial areas like Adabraka. He mentioned that crimes of this nature often involve insider knowledge, underlining the need for owners to minimize on-premises cash holdings to deter such robberies.

“We have said this over and over again because the fact that you are operating businesses that attract huge sums of money requires that you don’t keep large amounts of cash on-site, as such crimes are often insider jobs.”

He urged the public to maintain high standards of hygiene and sanitation, emphasizing practices such as frequent hand washing and ensuring that schools, workplaces, and marketplaces provide access to clean water and handwashing facilities.

“Let’s make sure we keep a sanitary environment around us, washing our hands regularly as we did during COVID. Schools, workplaces, and marketplaces should all prioritize cleanliness, so that even if someone contracts cholera, it doesn’t spread,” he stated.

He also pointed out that as blind individuals age, they become susceptible to conditions like hypertension, diabetes, and other age-related illnesses. However, without sufficient support, the costs of managing these chronic conditions become overwhelming, especially for those without regular income or pensions.

Dr. Obeng-Asamoah called on the NHIS to consider providing advanced healthcare options to the visually impaired community, including regular screenings, access to specialists, and affordable medications for chronic conditions.

“There is no policy that shows we receive anything extra,” he said. “This is serious because many blind people, and people with disabilities in general, are unemployed or live in rural areas without job opportunities. They are aging without pensions and facing health conditions like hypertension and diabetes that everyone else does, yet they have no income to support their healthcare needs.

“As it stands, there is no special priority for blind persons, and this is an area we hope the government will urgently address.”

During the donation event at NOVA’s Weta fuel station, Managing Director Kwasi Zigah highlighted the company’s commitment to Ghana’s 2024 carbon neutrality goal. Mr. Zigah noted that by shifting food vendors away from charcoal to cleaner energy, NOVA is reducing greenhouse gas emissions and empowering women in rural areas.

“Charcoal is carbon-intensive, and by donating clean cooking stoves to commercial food operators, we are supporting local businesses and advancing green cooking,” he stated.

NOVA also announced a cylinder exchange program, allowing customers to swap old cylinders for new ones, paying only for the gas. Additionally, NOVA offers home gas delivery and promises competitive fuel prices, backed by CH Group’s fuel import, storage, and transport operations in Ghana.

Beneficiaries of the clean stoves expressed their gratitude. Ms. Mary Poasiegah, speaking on their behalf, said, “We are very grateful to NOVA for this donation. These stoves would have been expensive if we bought them ourselves.”

According to the Central Bank, the stress test indicated that most banks would survive daily deposit withdrawals of 1.0% to 4.0% over 30 days if the GoG bonds market was liquid.

However, most banks would not survive a run of more than 1.0% of daily deposit withdrawals for 30 days if the GoG bond market is illiquid.

Interest Rate Risk

The banking sector appears robust against interest rate risk.

The results of a stress test showed that a 16.0 percentage point increase in interest rates persisting over the next year may lead to a decline in the Capital Adequacy Ratio (CAR) from a post-Eurobond restructuring level of 13.85% to 11.57%.

The report stated that an extreme decline in interest rates may improve the solvency conditions in the banking sector, given that more liabilities would reprice over the one-year horizon compared to assets. Accordingly, a steady decline in interest rates is expected to improve the solvency conditions in the banking industry.

Exchange Rate Risk

The Bank of Ghana noted that exchange rate fluctuations have a minimal impact on solvency conditions in the banking sector.

The test results indicate that an unexpectedly large movement of the Ghana cedi against the US dollar may have minimal direct impact on the solvency of banks, reflecting the existing limits on the Net Open Position (NOP) within the banking industry.

This includes working with banks to improve the use of credit reporting and collateral registry systems, as well as increasing onsite supervision.

This will be achieved by undertaking periodic thematic loan book reviews of banks to ensure that losses are fully recognized early and accounted for.

In the 2024 Financial Stability Review, the Central Bank stated that the banking industry’s resilience to heightened credit risk, following the full impact of the debt restructuring, is relatively weak.

“Non-performing loans remain elevated, reflecting the lagged effects of the COVID-19 pandemic and the recent macroeconomic challenges. The stress test revealed that if the macroeconomic recovery is largely slow-paced, leading to a mild deterioration in credit quality, the Capital Adequacy Ratio (CAR) may reduce further over a one-year horizon.”

“Solvency conditions could marginally decrease below 10% if macro-financial conditions one year ahead lead to severe deterioration in credit quality,” it added.

The results, the Central Bank indicated, reinforce the need to ensure a robust macroeconomic recovery in the near to medium term.

To contain credit risks, it explained that banks must maintain a sound credit risk management system and adhere to the Bank of Ghana directive on suspending dividend payments while frontloading recapitalization plans.

The credit risk stress test estimates the sector’s solvency position following an extreme but plausible deterioration in the quality of loan assets. The impact of the decline in credit quality on the solvency position is estimated using the loan migration model.

The loan migration model stresses banks’ loan portfolios by reclassifying loans to reflect a higher degree of loan impairments under the following assumptions.

Bawumia also questioned Mahama’s focus on infrastructure, suggesting that while infrastructure is important, it is secondary to the current administration’s digitalization-led approach.

“Mahama boasts of his infrastructure achievements, but today he claims infrastructure doesn’t affect the economy. How can someone who has led this country not see the connection between infrastructure and economic growth? This mindset explains why the economy struggled under his leadership.”

Bawumia further expressed doubt about Mahama’s proposed “24-Hour Economy Policy,” describing it as impractical and unclear.

“His signature 24-hour economy idea lacks coherence. It’s become a case of ‘one day, one explanation,’ including ideas as varied as rearing lions and elephants. With me, you’ll have a brand new leader, not a recycled one.”

OHPAG, in a statement, highlighted that other nursing professionals have received multiple rounds of financial clearance and postings in recent years.

This oversight has left many dental clinics across Ghana understaffed, with some facilities resorting to unlicensed personnel to fill gaps, contravening Act 857 of 2012.

In light of Ghana’s high oral disease prevalence, which impacts nearly half of the population, OHPAG stresses that recruiting these dental assistants would ease the strain on oral health services and advance the nation’s Sustainable Development Goal 3 targets.

The Association urges the government to grant financial clearance swiftly to enable these trained professionals to serve the public and enhance Ghana’s healthcare system.

Growing up in Jamestown, Ghana, he developed a strong connection to his heritage. After attending Ridge Church School and Mfantsipim School, he moved to the U.S. in 1982, where he graduated from Westlake High School in Texas and earned a Bachelor of Science degree in Industrial Technology from Texas State University. His exposure to new ideas in the U.S. ignited his passion for harnessing technology to drive economic transformation.

After a brief stint in the U.K., Herman returned to Ghana to co-found theSOFTtribe Limited in 1991, one of West Africa’s earliest software companies. theSOFTtribe focused on “tropically sensitive” software solutions for African businesses, including Akatua (payroll system), Eziban (restaurant management), Efuom (farm management), and Hei Julor!!! (a mobile security alert system). Under Herman’s leadership, theSOFTtribe expanded its impact across West and East Africa, becoming synonymous with innovation in the African tech space.

Herman’s thought leadership gained him international recognition. He spoke at esteemed forums like Harvard Business School, United Nations conferences, and TED Global. He was also featured on CNN, BBC, and in Forbes, which recognized him as a leading figure in Africa’s tech ecosystem. Herman’s accolades included the World Economic Forum Technology Pioneer award (2008), Ghana Millennium Excellence Award for ICT, and the Lifetime Achievement Award from the Ghana Entrepreneur and Corporate Executive Awards. He was also Ghana’s Best Entrepreneur in ICT and a Microsoft African Partner of the Year.

Among his notable innovations, Herman recently developed “Afrikan Echoes,” an app delivering authentic African stories globally. His dedication to African development extended to real estate, where he created Lubango Heights in Aburi, a premier retreat destination, and Graceland Memorial Garden in partnership with Gethsemane Cemetery.

In his personal life, Herman married Sadia Clarke in 1993. They were proud parents to Nii Tetey and Naa Densua and grandparents to Luca and Bria, born in 2024. His larger-than-life personality, love for music—especially Brazilian, jazz, reggae, and highlife—alongside his insightful speeches, inspired countless Africans.

This decision also denied Bagbin’s effort to nullify a writ filed by Majority Leader Alexander Afenyo-Markin, which sought judicial intervention to prevent the Speaker from making further declarations on the disputed seats.

In an interview on Accra-based Channel One TV, Mr. Amaliba argued that the Supreme Court’s ruling oversteps constitutional boundaries. He contended that the judiciary should not interfere in matters involving Parliament, particularly when the two major political parties are at odds.

According to him, “If the framers of the Constitution did not intend for such interference, it is not within the Supreme Court’s purview to insert it now.”

Mr. Amaliba expressed concern that this decision might set a “dangerous precedent” with lasting implications, adding that it would not have been accepted had an NDC lawyer filed the writ. He described Afenyo-Markin’s application as flawed and labeled the Supreme Court’s handling of the case as hasty, accusing it of disregarding the Constitution.

Speaker Bagbin, represented by lawyer Thaddeus Sory, argued that the Supreme Court’s suspension of his ruling overstepped its authority, as his decision on the seats was a parliamentary matter. “Herman Chinery-Hesse was born on November 18, 1963, in Dublin, Ireland, into a distinguished Ghanaian family with a rich tradition of public service. His father, Lebrecht James Chinery-Hesse, was a prominent legal draftsman, while his mother, Mary Akuokor Chinery-Hesse (née Blay), was a seasoned diplomat and the first woman to attain the rank of Under Secretary-General at the United Nations,” the funeral brochure noted.

“Raised in Ghana, Herman spent his early years in Jamestown with his extended family, fostering a deep connection to his heritage. He began his education at Ridge Church School and later attended Mfantsipim School, where he laid the groundwork for his future in technology and entrepreneurship.”

In 1982, Herman moved to the United States, where he completed high school at Westlake High School in Texas.

He went on to earn a Bachelor’s degree in Industrial Technology from Texas State University, where he was introduced to the transformative potential of technology.

According to him, the notion that the national security apparatus has not been fully aware of the events occurring in the Bawku township is untrue.

“I completely disagree that the national security or the security architecture of this country has never been fully aware of all the events that are happening in Bawku,” he stated.

Speaking on JoyNews’ Newsfile on Saturday, Mr. Agbambilla asserted that the ongoing conflict in Bawku is largely driven by the perception among the Mamprusi community that, because they count Vice President Dr. Mahamudu Bawumia as one of their own, they can use his position to perpetrate the violence currently affecting the area.

He noted that national security previously detected the potential for unrest and issued an injunction to prevent the funeral rites of a long-deceased chief—a decision many warned could lead to conflict.

“Then later we heard there was some purported enskinment in Bawku, and the government issued an arrest warrant for the arrest of Seidu Abagre,” he said.

He stated that unless the government or security intelligence deliberately chooses not to pursue an individual, if someone commits wrongdoing, they will certainly be found, suggesting that intelligence failures are not the main issue.

The lawyer for the Bawku Naaba argued that Seidu Abagre, whose return to Bawku has exacerbated tensions between rival factions and resulted in multiple clashes, is living as a free man despite his arrest.

He questioned how someone who is supposedly hiding could have lawyers and give instructions to people going to court.

“The government did not want to act. National security just didn’t want to act,” he stressed.

He added, “I don’t think that the security architecture is unaware of what is happening in Bawku. It is because some people think that by giving the Mamprusis in Bawku what they want, it may brighten the chances of Dr. Bawumia.”

His comments followed remarks by a lecturer at the Kofi Annan International Peacekeeping Training Centre (KAIPTC), Dr. Victor Doke, who pointed to lapses in security intelligence as a possible factor in the renewed conflict.

Dr. Doke argued that inadequate intelligence monitoring and preventive measures may have allowed the recent violence, which resulted in approximately 19 deaths. He expressed concerns about the readiness of security services, given the known tensions in the area.

This collaborative process included input from over 300 experts across Ghana, creating a comprehensive curriculum designed to reshape the educational landscape.

Teacher preparation has been central to the curriculum’s development, with ongoing Professional Learning Community (PLC) sessions held weekly to equip teachers with the skills needed for effective implementation.

To support educators further, the Ministry of Education, alongside subject-specific associations, has developed teacher manuals tailored to the new curriculum, ensuring they have the resources necessary to guide students effectively.

The new curriculum is built around three main outcomes: equipping students with essential 21st-century skills to navigate modern challenges, providing a strong academic foundation for further education, and preparing learners for the workforce with the competencies and character qualities essential for professional success and societal contributions.

Through this curriculum, students will be prepared to lead responsible lives, pursue higher education, and confidently enter the job market.

A distinctive feature of the new curriculum is its focus on shared Ghanaian values.

It seeks to foster a sense of pride and responsibility in learners, encouraging an appreciation for Ghana’s cultural heritage.

The curriculum also includes flexible learning pathways, enabling students to select subjects that align with their interests and career aspirations.

Additionally, intervention programs in mathematics and English will support students needing extra assistance in these core subjects.

The new assessment methods also focus on critical thinking, creativity, and problem-solving skills.

Speaking on the new curriculum, Prof. Yayra Dzakadzie, Director-General of NaCCA, stated, “This curriculum is designed to be transformative, shaping the next generation of Ghanaian leaders.

“It’s more than an update; it’s a groundbreaking shift toward equipping learners with essential skills for success in today’s fast-paced world. At its core, the curriculum is committed to nurturing critical thinking, fostering creativity, and honing problem-solving abilities.”

He noted that this is Ghana’s first SHS curriculum to emphasize shared Ghanaian values, aiming to inspire pride in the nation and a dedication to its growth and development.

He cited the NPP’s steady increase in regional support—from 10.81% of total votes in 2016 to 14.14% in 2020—as evidence of this progress.

However, Mr Agbleze has dismissed the NPP’s goal as unrealistic, pledging that the NDC will not concede its stronghold.

“We are unwavering in our commitment to protect the Volta Region’s loyalty to the NDC. The public should see through the NPP’s empty promises and reject the propaganda they continue to spread,” he stated.

Agbleze further urged the NPP to shift its focus toward national economic recovery rather than raising expectations in the Volta Region.

“The NPP’s projection of securing half the votes here is not only delusional but frankly disrespectful to Voltarians.

“Their history of setting unattainable goals speaks to a pattern of overpromising and underdelivering, which has steadily eroded their credibility nationwide,” he said.

Agbleze called on Voltarians to show their enduring support for the NDC, underscoring that the party remains the region’s and Ghana’s best hope for meaningful change.

With a voter base of 1,023,147 registered individuals in the Volta Region, the NDC believes it can continue its legacy of strong support in the upcoming election.

Thirty farmers are involved, raising concerns that, despite COCOBOD’s oversight, the cocoa industry continues to grapple with these issues, which have affected the sector for over a decade.

The farmers argue that these persistent challenges harm the welfare of cocoa producers and their communities, asserting that COCOBOD’s monitoring and response efforts have not adequately protected them.

The University of Ghana School of Law, Civic Response (a non-profit organization), and the Chicago-based Corporate Accountability Lab are supporting this action.

They seek to bolster accountability within COCOBOD to improve conditions across Ghana’s cocoa industry.

The complaint notes that despite COCOBOD’s sustainability efforts, challenges such as deforestation, limited agroforestry progress, toxic pesticide use, and child labor remain prevalent in Ghana’s cocoa industry.

These issues, the complaint claims, persist due to complex supply chains and low prices from cocoa buyers, calling for substantial change.

Efforts to counter cocoa smuggling have also fallen short, with Ghana losing approximately 120,000 metric tons of cocoa beans to smuggling in 2022-2023, threatening the national economy.

Smuggling has worsened as neighboring countries offer higher prices, intensifying the need for action.

COCOBOD’s ESMS, established in 2018, provides a framework for managing environmental, social, health, and safety risks across its operations, subsidiaries, and partners.

This complaint seeks to hold COCOBOD accountable under this system, emphasizing its duty to safeguard the industry and its workers.

Central to their complaint is the assertion that Dioretey allocated DRIP project machinery and a GH¢400,000 maintenance fund to the NPP candidate, who has no formal role within the district assembly or rights to these resources.

Ranking Member of Parliament’s Local Government and Rural Development Committee, Edwin Nii Lante Vanderpuye, condemned the alleged actions and urged the OSP to act swiftly.

He emphasized the importance of imposing penalties on the DCE to uphold public trust in local governance.

“Why has the NPP candidate been given access to public resources? Is she a member of Parliament or the District Chief Executive? We have petitioned the OSP for a thorough investigation and immediate action against the DCE,” he stated.

“Almost GH¢400,000 intended for each district assembly’s DRIP management has reportedly been handed over, along with machinery, to a candidate with no legitimate ties to these assets while there is an incumbent MP who approved this funding in Parliament,” he added.

The DRIP initiative was designed to improve district road infrastructure, support rural transport routes, and promote accessibility.

The Minority caucus contends that these resources should not be diverted to individuals seeking political office, particularly when they lack any formal administrative or elected responsibilities in local government.

In an interview with Citi News, Mr. Tanko Musah stressed the pressing need for adequate rest periods, emphasizing the heavy toll the double-track system has placed on teachers.

He urged the government to implement a robust compensation plan for educators working within this system, noting that support for teachers is essential to their well-being and the overall quality of education.

“Providing leave is essential—it allows workers to rest, recharge, and prepare for their duties. Even labor laws mandate compulsory leave. If vehicles require regular servicing, then humans surely need rest, too.

“Teachers in double-track schools are overworked and lack proper compensation. If the double-track system remains in place, there must be a plan to provide fair compensation. We cannot expect teachers to work around the clock without appropriate support,” he added.

In a statement, the staff groups shared that during the meeting, they advised authorities to withdraw the merger bills from Parliament as a condition for further discussions.

Subsequently, on October 17, the Minister, Herbert Krapa, requested in a letter to the Clerk of Parliament to pause the bill’s progression.

In response, the staff groups affirmed their commitment to maintaining essential services, announcing a partial suspension of certain actions until the bills are fully withdrawn.

They also urged swift action to support a stable work environment and expressed trust that the Minister would facilitate “a peaceful industrial atmosphere at the VRA and NEDCo.”

These findings highlight a public focus on job creation, improved connectivity, and essential services.

The report further illustrates the economic hardships faced by many Ghanaians: 82% reported some level of poverty over the past year, with 45% experiencing moderate to severe economic distress—a sharp rise from 19% in 2017.

Additionally, 70% of respondents reported going without cash income at least once in the past year, with many also facing shortages in essential services, including medical care (54%), water (44%), food (44%), and cooking fuel (42%).

Less than half (45%) expect economic conditions to improve in the next year, and ratings of the government’s economic performance have declined, reflecting frustration with the rising cost of living and limited access to essential services.

A statement issued and signed by the Management of the Ghana Shippers’ Authority (GSA), and copied to the Ghana News Agency, described this as a landmark legislation achieved in GSA’s 50th year. It noted that the Act strengthens the GSA’s regulatory mandate, establishing a robust, fair, and internationally competitive environment for commercial shipping in Ghana.

The statement added that the new Act now enables the GSA to regulate across all modes of transport—sea, air, and land—to ensure fairness, efficiency, and integrity within the shipping and logistics sector.

“Ghana’s shipping industry stands to gain from this fortified oversight, which safeguards transparency in pricing and fairness in service delivery, establishing Ghana as a destination of choice for international trade,” it said.

To realize the Act’s overarching aims, the GSA has embarked on a nationwide sensitization campaign to educate stakeholders about their rights and responsibilities under the new law.

Additionally, the GSA is gathering input for a Legislative Instrument (L.I.) that will aid in operationalizing the Act. All stakeholders are encouraged to actively participate in this exercise for the mutual benefit of the sector and the nation.

The Ghana Shippers’ Authority extended profound gratitude to all stakeholders whose invaluable input shaped this legislative milestone. “Together, we have laid a foundation for a resilient, sustainable, and competitive commercial shipping ecosystem that will benefit all parties involved in the shipping, logistics, and broader trade sectors,” it stated.

Similarly, the Three-Tier Pension Scheme’s AUM at the end of December 2023 stood at GH¢61.8 billion as compared to GH¢46.6 billion recorded in 2022.

According to the Financial Stability Review, pension funds increased by 33.0% in 2023, compared to the 20% h recorded in 2022.

The increase in growth, the report said, is attributable to the outcome of the alternative offer to pension funds which saw a high participation rate of about 95.0%, as well as the government’s commitment to meeting its payments obligations under the offer.

Also, the government’s partial redemption of contributions and the prosecution of employers defaulting on the mandatory pension schemes contributed to the surge in AUM.

Private Pension Fund

The Private Pension Funds was the main driver of the growth witnessed in the industry.

Total private pension funds grew by 32.0% in 2023 compared to 26.0% recorded in 2022.

The year-end total for private pension funds under management for 2023 was GH¢46.5 billion compared to GH¢ 35.3 billion recorded in 2022. The sustained growth in pension funds is attributable to better return on investments and the prosecution of employers defaulting on Tier 2 contributions.

Public Pension Funds

The pension funds under the Basic National Social Security Scheme (BNSSS) grew relatively stronger compared to the recent past.

From a total AUM of GH¢12.11 billion in 2022, the year-end AUM for 2023 was GH¢15.30 billion arising from payment of contribution arrears by the government.

This represented a 26.3% increase in 2023, compared to a 4.9% increase in 2022.

Alan Kyerematen commended the Speaker for his stance on vacating the seats but noted that challenging the Supreme Court’s interpretative jurisdiction was a misstep.

He argued that the Supreme Court should respect the separation of powers, recognizing Parliament’s independence in decisions made by the Speaker.

Emphasizing the importance of constructive engagement among government branches, Mr. Kyerematen warned that prolonged conflicts could be detrimental, especially with elections approaching, and urged a timely resolution.

“Speaker Bagbin must first accept the Supreme Court’s decision to grant an injunction that stays his initial order. He should then file another application to request the Supreme Court to reconsider this injunction, arguing that, under the Constitution, there is no issue of interpretation at play.

“This implies that Afenyo-Markin’s injunction on Parliament to pause the Speaker’s decision is unwarranted as it does not require interpretation of any constitutional provision and thus should not be presented to the Court for interpretation,” he added.

He cautioned that the ongoing constitutional dispute could spiral into chaos without intervention.

This follows the Supreme Court’s recent dismissal of Speaker Alban Bagbin’s application to overturn a ruling that suspended his declaration of four parliamentary seats as vacant.

Speaking on Joy FM’s Super Morning Show, Prof. Gyampo argued that the situation calls for intervention beyond the judicial process.

“This matter, in my view, wasn’t a matter that was supposed to be settled at the court. If there are elders in Ghana, if we have a Council of State that is functioning, this is the time they would have to intervene and settle matters,” he said on Thursday.

He noted that the high level of political partisanship has hindered constructive mediation by traditionally neutral institutions, creating an environment where institutions are reluctant to resolve issues outside formal legal channels.

“We have succeeded in politicising every institution of government…such that we don’t have people in Ghana now with moderate influence, who will be able to intervene,” he observed.

Prof. Gyampo warned that the ongoing court intervention risks intensifying the conflict between Parliament and the judiciary, leading Parliament to resist what it may view as judicial overreach.

“This current matter before the court is not one that the Supreme Court can settle in a manner that will bring about peace… Parliament would assert itself and will not allow itself to be made subservient to the judicial arm of government.

“And so what is going to happen? Chaos!” he stressed.

Calling on the Council of State to step up, Prof. Gyampo urged eminent Ghanaians to assume the role of mediators to prevent a constitutional crisis.

“If the Council of State…wants to perform their role, then I think that we may be able to bring about some resolution to this impasse,” he stated.

Background

The Effutu MP, Alexander Afenyo-Markin initiated the court process after Speaker Alban Bagbin declared four parliamentary seats vacant.

The Supreme Court, therefore, issued a stay in Speaker Bagbin’s declaration. The Speaker also countered with a suit seeking to overturn the Court’s ruling that suspended his declaration of four parliamentary seats as vacant.

The Speaker’s legal team argued, among other grounds, that the Supreme Court lacked jurisdiction in this case.

However, after hearing arguments from all parties, including the Attorney-General and Minister for Justice, the Supreme Court maintained that its earlier ruling was appropriate, stating that the Speaker’s appeal was without merit.

Parliament to reconvene

Meanwhile, a five-member delegation of the Council of State, led by the Chairman, Nana Otuo Siriboe II, has paid a courtesy call on the Speaker to ascertain first-hand, happenings in the Legislature in recent times, resulting in the adjournment of the House indefinitely.

It was during this visit that the Speaker revealed that his office had already started processes to recall the House.

He said the office is working towards the recall of the House in early November.

“Personally, I consider everything leading up to yesterday as inconsistent,” he said.

He explained, “We have a Speaker who received an order that he himself failed to agree with, but on the day he sat in Parliament and made a ruling, he acknowledged this order. Then, in the next moment, he sent the order back to the Court on the basis that it was not properly served on him. Yet, he then went ahead and filed an application in the Supreme Court regarding the very order he claims was not properly served on him. This is inconsistency and poses an agenda, which is that somehow Parliament must be in a stalemate.”

On Wednesday, October 30, 2024, after a day-long hearing of the Speaker’s application, the Supreme Court denied his request.

This followed an initial suit filed by Effutu MP Alexander Afenyo-Markin, challenging the Speaker’s declaration of four parliamentary seats as vacant.

The four controversial seats are held by Peter Yaw Kwakye Ackah of the NDC from Amenfi Central constituency in the Western Region; Andrew Amoakoh Asiamah of Fomena in the Ashanti Region; Kojo Asante, NPP MP for Suhum in the Eastern Region; and Cynthia Morrison of the NPP from Agona West constituency.

The group expressed frustration that the government has not fulfilled its commitments despite over a year of negotiations with the Fair Wages and Salaries Commission, which ultimately led to mandatory arbitration by the National Labour Commission.

This perceived inaction has prompted the members to prepare for a strike.

The group also criticized CETAG leadership, accusing them of aligning too closely with the government and undermining members’ demands.

At a press conference on Tuesday, October 30, the group’s National Public Relations Officer, Suleman Mohammed Mustapha, announced that if their demands, including migration to the same salary structure as university lecturers, are not met, they will strike on November 8, 2024.

Mustapha emphasized the pay disparity, explaining that teachers at universities with equivalent qualifications earn significantly more.

“In public universities, even the lowest rank earns more than a chief tutor, the highest rank in colleges of education. This stark inequality is a glaring injustice against college lecturers. We demand to know why the government underpays qualified lecturers like us,” he stated.

Speaking after a forum organized by the Institute of Democratic Governance (IDEG) on the theme “Moderating the Airwaves for Peaceful and Credible Elections 2024,” NMC Executive Secretary George Sarpong highlighted the app’s potential to support peaceful elections and safeguard journalists.

“This app will be a game-changer, providing highly accurate information from polling stations across Ghana,” Mr. Sarpong stated.

“In terms of election results, anyone present at a polling station can record and submit footage as results are declared. The system will then verify the authenticity of the submitted content.”

“In the case of any disputes, this tool will provide solid evidence for those seeking to understand what occurred and to address any issues effectively,” he added.

A formal directive from the Chief Justice was sent to judges in the region, ordering the immediate closure of the courts to safeguard judges, court staff, and the public.

Speaking to Citi News, Saviour Kudze, Public Relations Officer of the GBA, explained that the decision was made in consultation with security forces, who provided crucial intelligence and insights on the growing security threats.

“In light of the developments outlined by the Chieftaincy Minister, I believe intelligence from security agencies necessitated the court closures to ensure safety.”

He added that the judiciary’s intent in closing the courts is to prevent potential risks to judicial staff and officers, who might otherwise be caught in the crossfire of the unrest.

Mr. Kudze also hinted at the possibility of alternative arrangements if the situation does not stabilize soon, mentioning the reassignment of cases to nearby regions, such as Tamale, to avoid backlog and uphold individuals’ legal rights amid the court closures.

“The Chief Justice, as head of the judiciary, is in regular contact with security agencies. Following the latest updates from the Chieftaincy Minister, the intelligence they provided likely informed the decision to close the courts.”

The Chief Justice’s circular indicates that the closures are indefinite for now, but the situation will be closely monitored. If necessary, the judiciary may relocate cases to maintain continuity in the judicial process.

Speaking on the second day of his tour of the Northern Region, former President Mahama questioned the independence of the judiciary and the autonomy of state institutions.

He claimed this deterioration has led to global disappointment in the country’s governance model.

“Anywhere I go, the question people outside Ghana ask me is, ‘Ghana, what happened to you? Kwame Nkrumah’s Ghana, what happened to you?’

“Everybody looked up to Ghana as the model of democracy, but today, we are a bad model of democracy. Our judiciary is not independent, and all our state institutions have been undermined. People once viewed Ghana as a country that exemplified economic management; today, our economy is in shambles,” he said.

Mr. Mahama’s criticisms come amidst the ongoing suit involving Effutu MP Alexander Afenyo-Markin and the Speaker of Parliament. Mr. Afenyo-Markin initiated court proceedings after Speaker Alban Bagbin declared four parliamentary seats vacant.

The Supreme Court subsequently issued a stay on Speaker Bagbin’s declaration. The Speaker countered with a suit seeking to overturn the Court’s ruling that suspended his declaration of the four parliamentary seats as vacant.

The Speaker’s legal team argued, among other grounds, that the Supreme Court lacked jurisdiction in this case. However, after hearing arguments from all parties, including the Attorney-General and Minister for Justice, the Supreme Court maintained that its earlier ruling was appropriate, stating that the Speaker’s appeal was without merit.

Comparing NPP’s economic leadership with that of former President John Mahama, he contended that Mahama’s administration was more effective and had greater oversight.

In an interview on Asempa FM’s Ekosii Sen show, Dr. Spio-Garbrah argued that, while the Economic Management Team (EMT) exists, ultimate control lies with the Finance Minister, whose close relationship with the President has made accountability difficult.

He highlighted that, despite attempts by over 90 NPP Members of Parliament to remove the Finance Minister, President Akufo-Addo’s support enabled him to remain.

“John Mahama has relevant experience in managing the economy; he performed better than the current chairman of the Economic Management Team, Bawumia. The NPP has failed the country. Although there is an Economic Management Team (EMT), the finance minister holds ultimate power, depending on how the president manages the situation.

“Under previous administrations, the EMT did not have such power, but because the finance minister is the president’s cousin, it is difficult to control him. Even when the majority of MPs wanted to remove the finance minister, their efforts were unsuccessful because the president did not support it.

“Whatever actions the finance minister took were with the president’s knowledge and approval. The nepotism was evident,” he said.

The awards are expected to promote positive behaviour change in the fisheries sector.

The winners include Edward Tetteh Amesimeku, the most responsible fisher, Joana Quaicoe, the most responsible fish processor and the Azizanya community in the Greater Accra Region, the most responsible fishing community.

Other awards were presented for cleanest landing beach, best community fisheries leader, and best fisheries reporter. Award winners received citations, community dustbins, public address systems, canopies, and chairs, depending on the category.

“Today’s ceremony presents an opportunity to recognize those who are making significant contributions to safeguarding the future of Ghana’s fisheries,” said Andrew Read, USAID/Ghana Economic Growth Office Director.

“The United States supports responsible fishing in Ghana because fish are an essential source of food, nutrients and livelihoods for millions of Ghanaians,” he added.

The awards were organized under the USAID-supported Feed the Future Ghana Fisheries Recovery Activity and recipients were selected based on their compliance with fishing regulations, sustainable fishing methods, hygienic fish handling and processing techniques, among others.

The United States is Ghana’s largest bilateral development partner.

In 2023, bilateral assistance from USAID totalled over $140 million dedicated to supporting economic growth and agriculture, health, education, governance, and more.

USAID is providing $24 million (over GH¢355 million) in multi-year investments to restore Ghana’s coastal fisheries and improve ocean conservation along the coast.
