Afoko’s lawyers should not submit to another trial- expert

A legal expert, Kwaku Asare has called on the lawyers for Gregory Afoko not to submit to another trial after the issuance of a nolle prosequi against his trial.

Gregory Afoko was arrested as the prime suspect after Adams Mahama who was the Upper East region New Patriotic Party Chairman was allegedly attacked in front of his home in Bolgatanga with acid leading to his death in May 2015.

Speaking on Adom FM’s Dwaso Nsem Show on Wednesday, Lawyer Asare urged the lawyers of the first suspect to proceed to a superior court.

“The lawyers must not submit themselves to any trial but should immediately go to the Supreme Court and ask the court to decide whether a nolle prosequi can be issued when a trial is about to end, whether is fair, conforms to good trial and allows such things to happen.”

“In my mind, there is no way such things can happen but if that is the case, and then we are not safe.”

Lawyer Asare further stated the Attorney General was only abusing its powers because there is no way a suspect can be remanded for four years and afterwards be issued a nolle prosequi.

“There is no way you can remand someone for the person to waste all available resources in fighting a case then you later come out to issue a nolle prosequi because you realise the case is not going in your favour.”

He could not fathom why in a liberal democracy like Ghana, equality before the law is being subverted.

“Why should an ordinary man be treated differently from a politician when it comes to court hearing and criminal cases? I can assure you people would have protested if he was a politician and was even called for interrogation by the BNI.”

The first suspect Gregory Afoko angrily spoke out after a hearing at a district court in Accra, where he was re-arraigned alongside the second suspect Asabke Alangdi, who was arrested in Ivory Coast after hiding for nearly a year.

“Why do you treat me like this? You brought 14 witnesses and they were all withdrawn; and you are still polishing those lies. I’ve done nothing wrong. Why do you treat me like this? The Police should be honest, stop the lies. I’ve not committed any crime. That man [Adams Mahama] is my sister’s son.

Why are you twisting the story?” he complained after the court case.

“Am I killing Adams to take his trousers or his shirt? You people are twisting the stories.”
