Lawyers for Akwatia MP Ernest Yaw Kumi were on Wednesday, February 26, prevented from moving a motion to set aside an injunction restraining him from holding himself as a legislator.
A five-member panel led by Justice Gabriel Pwamang questioned whether Kumi had purged himself of contempt before seeking relief from the Supreme Court.
“We are all superior courts, and we are aware that the High Court in Koforidua made orders in the nature of contempt. If you are in contempt, you would purge yourself. You don’t avoid answering it and then you’re given a hearing,” Justice Pwamang stated.
Kumi’s counsel, Gary Nimako Marfo, argued that the High Court had disregarded documents filed by his client and that the Supreme Court motion predated the contempt ruling.
However, Bernard Bediako, counsel for the first interested party, countered that Marfo had already filed another motion seeking to overturn the contempt judgment.
Kumi, who was absent from proceedings, was represented by Minority Leader Alexander Afenyo-Markin.
After a brief recess, the court adjourned the matter to March 12 and ordered all parties to file written submissions within seven days.
