Supreme Court to deliver judgment on anti-LGBTQ+ case today

The Supreme Court is set to deliver its ruling on two landmark lawsuits challenging the constitutionality of the Human Sexual Rights and Family Values Bill, commonly known as the anti-gay bill.

This judgment follows months of heated public debate and political contention over the proposed legislation.

The bill aims to criminalize activities associated with LGBTQ+ advocacy.

If enacted, it would impose penalties on individuals who promote or fund pro-LGBTQ+ initiatives and even extend liability to those providing indirect support.

Supporters argue that, the bill is essential to preserving Ghanaian cultural and family values, which they claim are being undermined by foreign ideologies.

Opponents, however, contend that it infringes on fundamental human rights, including freedom of expression, association, and equality under the law.

The legal challenges, brought forward by journalist and lawyer Richard Dela Sky and equality advocate Amanda Odioi, question the legislative process behind the bill.

The plaintiffs argue that, Parliament failed to meet the quorum requirements stipulated in Articles 102 and 104 of the Constitution when passing the bill, rendering the process unconstitutional and invalid.

The Supreme Court’s decision will determine whether the legislative process behind the bill adhered to constitutional standards, potentially setting a precedent for Ghana’s democratic governance and human rights obligations.
