The National Labour Commission (NLC) has announced that it has taken legal action in response to the ongoing strike by workers of the Ghana Highway Authority (GHA).
The strike began on Tuesday, November 12, 2024, with GHA workers protesting the implementation of the National Roads Authority Act, 2024 (Act 1118).
In a statement issued the same day, the NLC highlighted that the strike did not comply with the procedures required under the Labour Act, 2023 (Act 651).
The Commission directed the workers to suspend the strike and adhere to the established legal process.
Speaking to Citi FM, NLC Executive Secretary Ofosu Asamoah stated that the Commission had proceeded with legal action due to the workers’ noncompliance with its previous directive to follow proper channels.
“They did not follow the due process provided by law, which requires at least seven days’ notice to the Labour Commission, two notices to the Commission, and to their employers. Additionally, in this case, any strike declaration should come from the national union, not a divisional one.
“Before the strike, the Ministry had already petitioned the Commission, and the GHA workers had been summoned. We have initiated legal action, though if they decide to comply, we would pause court proceedings. Given that they have acknowledged skipping the due process, we hope they respect our directive, as it is in their best interest and that of all Ghanaians,” he explained.
